Public Disclosure and Penalties:
The DFEH would publish each employer's pay data report on a public website, with penalties of up to $100 per employee for failure to file, increasing to $200 for subsequent violations.
Filing deadline would change to the second Wednesday of May each year.
Expanded Pay Transparency Laws:
Employers would be required to provide pay scales in job postings and announce promotion opportunities with associated pay scales to all current employees simultaneously with public posting.
Enforcement and Remedies:
SB 1162 provides a private right of action for injunctive relief and allows employees to file complaints with the Labor Commissioner, who can impose civil penalties between $500 and $10,000 per violation.
